This case shows the value of combining several intellectual property rights where the creation concerned is an important asset for the brand.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Protecting an original product against a copy<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In another case, the firm represented a company holding rights in the design of a product, together with its French distributor, faced with the marketing of a product reproducing several of its features.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute concerned in particular <strong>ownership of the copyright, the originality of the creation and the comparison of the two products<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court of appeal confirmed that the creation was protected by copyright and that the competing product amounted to infringement. It also upheld the loss suffered by the distributor on the ground of unfair competition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These cases show that copyright litigation goes beyond the question of copying alone: originality, evidence of the creation, ownership, contracts, design rights and complementary grounds all have to be analysed together.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Defending a company sued over the reuse of a graphic motif<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A textile company was sued for copyright and design infringement and for <a href=\"https:\/\/www.cabinetbouchara.com\/en\/strasbourg\/unfair-competition\/\">unfair competition<\/a>, over the use of a typographic motif on clothing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The firm contested in particular <strong>the originality of the motif, the ownership of the rights claimed and the validity of the design relied on<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court dismissed the claims based on copyright and unfair competition and cancelled the French design relied on, in particular because of its earlier disclosure. It mainly comprises copyright, which protects original works of the mind, and neighbouring rights, which benefit performers and certain producers in particular. A single project may therefore combine several rights. An advertising film, for example, may involve those of the authors, the performers and the producer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How long is a work protected by copyright?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In principle, economic rights last for the author\u2019s lifetime, then for the calendar year of their death and the following seventy years (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article<em>lc\/LEGIARTI000006278937&#8243;>article L.123-1 of the French Intellectual Property Code<\/a>). Special rules nevertheless apply to certain categories of works and certain situations.
