The conditions of the measure and the powers granted are then determined by the President of the judicial court having jurisdiction on the merits.<\/p>\n<p style=\"text-align: justify\">It may in particular be considered where there are:<\/p>\n<ul style=\"text-align: justify\">\n<li>copied products offered for sale or held in a warehouse;<\/li>\n<li>unauthorised use of a trade mark;<\/li>\n<li>the reproduction of a creation;<\/li>\n<li>the exploitation of a patented process;<\/li>\n<li>the copying of software or of a database.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">It may also help to identify the origin, the scale or the manufacturing and distribution channels of the suspected infringement.<\/p>\n<p style=\"text-align: justify\">Because it departs from ordinary law and is exceptional in nature, the counterfeit seizure procedure is subject to strict rules.<\/p>\n<h2>How to prepare a counterfeit seizure<\/h2>\n<h3>Which court has jurisdiction?<\/h3>\n<p style=\"text-align: justify\">The application must be made to the court having jurisdiction over intellectual property disputes on the merits. The rules of jurisdiction vary according to the right relied on and the title concerned. Disputes relating to European Union trade marks fall within the exclusive jurisdiction of the Paris judicial court. The choice of court must therefore be checked before the application is filed.<\/p>\n<h3>What must be put before the judge?<\/h3>\n<p style=\"text-align: justify\">The application for a counterfeit seizure must be prepared and presented by a lawyer. It must set out the intellectual property right relied on, the applicant&#8217;s standing to act, the suspected facts, the places concerned and the measures sought.<\/p>\n<p style=\"text-align: justify\">The applicant must present the facts and the exhibits fully, rigorously and in good faith. Failing that, the person seized may ask the judge to withdraw the order. Applications for withdrawal are in fact relatively frequent.<\/p>\n<h2>How does a counterfeit seizure unfold?<\/h2>\n<h3>The ex parte application<\/h3>\n<p style=\"text-align: justify\">The judge examines the application without the person against whom the operations will be carried out being summoned or informed beforehand (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006410764\/\" target=\"_blank\" rel=\"noopener\">French Code of Civil Procedure, article 493<\/a>). This ex parte procedure preserves the element of surprise and prevents the disappearance of the material sought.<\/p>\n<h3>The judge&#8217;s order<\/h3>\n<p style=\"text-align: justify\">In the light of the material submitted, the judge may issue an order authorising all or part of the measures sought, at the applicant&#8217;s own risk.<\/p>\n<p style=\"text-align: justify\">That order allows the applicant to instruct a judicial commissioner (formerly known as a bailiff). It sets out the places in which the operations may take place, together with the searches, findings and seizures authorised.<\/p>\n<h3>The judicial commissioner&#8217;s intervention<\/h3>\n<p style=\"text-align: justify\">Before starting the operations, the judicial commissioner serves the application and the order on the person concerned (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006410769\" target=\"_blank\" rel=\"noopener\">French Code of Civil Procedure, article 495<\/a>). A reasonable period must allow that person to read them.<\/p>\n<p style=\"text-align: justify\">The judicial commissioner must keep strictly within the limits set by the order. They may not search another location or seize material falling outside the mission entrusted by the judge.<\/p>\n<p style=\"text-align: justify\">The judge may have authorised the judicial commissioner to be accompanied by an IT expert.<\/p>\n<p style=\"text-align: justify\">That expert must remain within the technical assistance role defined by the order. They may not direct the operations, conduct questioning themselves or extend the searches to material not specifically covered by the mission.<\/p>\n<h3>What does the counterfeit seizure report contain?<\/h3>\n<p style=\"text-align: justify\">The counterfeit seizure report is a document drawn up by the judicial commissioner. It states its date, the identification of the applicant and of the person seized, the details of the seizure (what took place and the list of documents seized), together with the commissioner&#8217;s name and signature.<\/p>\n<p style=\"text-align: justify\">The report also sets out how the operations unfolded and lists the items described, copied, taken or seized. It may then be used, together with the annexes seized, in the infringement action.<\/p>\n<h2>What can be seized during a counterfeit seizure?<\/h2>\n<h3>Descriptive seizure<\/h3>\n<p style=\"text-align: justify\">A descriptive seizure consists in describing precisely the products, processes or services suspected of infringement. Depending on the measures authorised, the judicial commissioner may take photographs, make findings and examine the potentially infringing products.<\/p>\n<h3>Actual seizure<\/h3>\n<p style=\"text-align: justify\">An actual seizure allows certain items or documents to be physically taken where that measure is authorised. It must comply with the conditions set by the order, in particular the condition that the price be paid.<\/p>\n<h3>Documents and computer data<\/h3>\n<p style=\"text-align: justify\">The judicial commissioner may also copy the documents and computer data expressly covered by the order where they are useful in establishing the origin, extent or distribution channels of the alleged infringement. They may not, however, carry out searches unrelated to the mission entrusted to them.<\/p>\n<h2>What happens if the expert oversteps their mission?<\/h2>\n<p style=\"text-align: justify\">Where an industrial property attorney assists the judicial commissioner, as authorised by the order, they must not step outside the role assigned to them.<\/p>\n<p style=\"text-align: justify\">The Bordeaux Court of Appeal thus annulled a counterfeit seizure report, holding, first, that the bailiff had carried out no search for the disputed products even though the order required it and, second, that the attorney had \u00ab manifestly stepped outside the role of assisting the bailiff with the description assigned by the order, by questioning the chairman of the appellant company, which led to the discovery of different finishes and sizes of statuettes of the Virgin of Lourdes alleged to be infringing. \u00bb<\/p>\n<p style=\"text-align: justify\">The Court held that this intervention had caused prejudice to the company seized and justified annulment of the report (Bordeaux Court of Appeal, 1st Civil Chamber, 10 November 2021, no. 18\/06847).<\/p>\n<h2>What deadline applies after a counterfeit seizure?<\/h2>\n<p style=\"text-align: justify\">After the operations, the applicant has <strong>twenty working days or thirty-one calendar days<\/strong>, whichever is longer, to bring proceedings on the merits. Failing that, the whole of the seizure, including the description, may be annulled at the request of the person seized (<a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000029932114\/2026-03-06\" target=\"_blank\" rel=\"noopener\">French Intellectual Property Code, articles R. 332-4<\/a>, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000019107879\" target=\"_blank\" rel=\"noopener\">R. 521-4<\/a>, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036990053\/2026-06-15\" target=\"_blank\" rel=\"noopener\">R. 615-6<\/a> and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039475608\" target=\"_blank\" rel=\"noopener\">R. 716-18<\/a>).<\/p>\n<h2>How are trade secrets protected during the seizure?<\/h2>\n<p style=\"text-align: justify\">The operations may give access to commercial, technical or financial information unrelated to the alleged infringement. The protection of <a href=\"https:\/\/www.cabinetbouchara.com\/en\/trade-secrets-law\/\">trade secrets<\/a> must therefore be taken into account when the order is drafted and while it is being carried out by the judicial commissioner.<\/p>\n<p style=\"text-align: justify\">The judge may in particular order the provisional sequestration of seized documents likely to contain protected information. The applicant then cannot access them immediately. The person seized must, for their part, identify the documents concerned and flag their confidential nature without obstructing the authorised operations.<\/p>\n<h2>How can a counterfeit seizure be challenged?<\/h2>\n<p style=\"text-align: justify\">The person seized has several types of remedy. It is possible to seek withdrawal of the order or annulment of the operations.<\/p>\n<h3>Seeking withdrawal of the order<\/h3>\n<p style=\"text-align: justify\">Withdrawal allows the order authorising the counterfeit seizure to be challenged. The application is made to the judge who issued that order.<\/p>\n<p style=\"text-align: justify\">Several grounds may lead the judge to withdraw the order:<\/p>\n<ul style=\"text-align: justify\">\n<li>The most frequent is a lack of good faith on the applicant&#8217;s part, where it has not disclosed the information to the judge fairly. For example, it did not inform the judge of an earlier dispute between the parties on the same or similar facts, or of a decision affecting how the case is perceived, and so on;<\/li>\n<li>the weakness of the title: trade mark not yet registered, right expired or without effect in France, unpublished design, unrecorded licence, lack of standing to act;<\/li>\n<\/ul>\n<h3>Seeking annulment of the operations<\/h3>\n<p style=\"text-align: justify\">Annulment allows the conditions in which the operations were carried out to be challenged, in particular where the judicial commissioner or the expert exceeded the limits of the order. It is sought before the court hearing the case on the merits.<\/p>\n<p style=\"text-align: justify\">The operations could thus be annulled on many grounds, in particular:<\/p>\n<ul style=\"text-align: justify\">\n<li>No reasonable period between service of the order and the start of the seizure operations;<\/li>\n<li>Failure to comply with the places specified in the order (for example, operations carried out by the applicant at an address other than the one provided for);<\/li>\n<li>Non-payment of the price where the order provided for it;<\/li>\n<li>Searches or seizures going beyond those authorised by the order;<\/li>\n<li>Seizure of documents or data unrelated to the suspected acts of infringement;<\/li>\n<li>Intervention by an expert beyond the technical assistance role entrusted to them.<\/li>\n<\/ul>\n<h3>Seeking release or limitation of the seizure<\/h3>\n<p style=\"text-align: justify\">Release or limitation make it possible, in the cases provided for by the applicable texts, to remove or restrict the effects of the seizure.<\/p>\n<p style=\"text-align: justify\">These remedies may in particular lead to the return of certain items, to restrictions on their use or to the annulment of all or part of the report. The judge may refuse the measure, or limit the searches and seizures sought, if the applicant does not sufficiently establish its right, its standing to act or the plausibility of the alleged infringement. The judge also checks that the measures sought are precisely defined and proportionate to the aim pursued.<\/p>\n<h3>Can the company be warned before the seizure?<\/h3>\n<p style=\"text-align: justify\">The application is filed and examined by the judge on an ex parte basis. Warning the company beforehand would risk compromising the element of surprise and allowing the products, documents or data sought to disappear. The application and the order are served on it at the start of the operations so that it can read them.<\/p>\n<h3>Can the judicial commissioner be refused entry?<\/h3>\n<p style=\"text-align: justify\">The person concerned cannot obstruct measures expressly authorised by the order. They may, however, read the application and the order, have their observations recorded in the report and challenge the measure afterwards. The judicial commissioner may not exceed the limits set by the judge.<\/p>\n<h3>Does a counterfeit seizure automatically prove infringement?<\/h3>\n<p style=\"text-align: justify\">No. A counterfeit seizure is a measure intended to gather evidence. It is not, in itself, a decision recognising the existence of infringement. It is for the court hearing the case on the merits to assess the material gathered and to determine whether infringement is made out.<\/p>\n<h3>How much does a counterfeit seizure cost?<\/h3>\n<p style=\"text-align: justify\">The cost depends on the complexity of the application, the number of places concerned, the measures authorised, how long the operations last and whether an IT or technical expert is involved.
