This extension can be generic (.com, .org, .net&#8230;) or territorial (.fr, .uk, .com.cn&#8230;).<\/p>\n<p style=\"text-align: justify\">The domain name must be registered with an accredited <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/registrar\/\" target=\"_blank\" rel=\"noopener noreferrer\">registrar<\/a>, depending on its availability and the applicable registration rules.<\/p>\n<p style=\"text-align: justify\">Indeed, domain names are in principle allocated on a first come, first served basis. There cannot be several strictly identical domain names.<\/p>\n<p style=\"text-align: justify\">In addition, some domain name extensions have strict allocation rules.<\/p>\n<p style=\"text-align: justify\">For example, domain names in &#8220;.fr&#8221; can only be attributed to :<\/p>\n<ul style=\"text-align: justify\">\n<li>Any entity or person with a legal existence in France;<\/li>\n<li>Any natural person residing in the European Union;<\/li>\n<li>Any legal entity with its registered office or principal place of business in the European Union.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">There are, however, notable exceptions to the first-come, first-served rule, in particular when a newly registered domain name infringes upon the prior rights of third parties, and in particular upon a prior trademark, whether it be <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/cybersquatting-cybersquatting\/\" target=\"_blank\" rel=\"noopener noreferrer\">cybersquatting<\/a> or <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/typosquatting\/\" target=\"_blank\" rel=\"noopener noreferrer\">typosquatting<\/a>. Specific procedures, in particular the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/udrp-uniform-domain-name-dispute-resolution-policy\/\" target=\"_blank\" rel=\"noopener noreferrer\">UDRP<\/a> and <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/syreli\/\" target=\"_blank\" rel=\"noopener noreferrer\">SYRELI<\/a> procedures, are then provided for in order to protect the rights of <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/brand\/\" target=\"_blank\" rel=\"noopener noreferrer\">trademark<\/a> owners.<\/p>\n<p style=\"text-align: justify\">The domain name can constitute a distinctive sign, in the same way as a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/company-name\/\" target=\"_blank\" rel=\"noopener noreferrer\">company name<\/a> or a sign.
