{"id":9020,"date":"2022-02-02T15:24:53","date_gmt":"2022-02-02T14:24:53","guid":{"rendered":"https:\/\/www.cabinetbouchara.com\/logiciel\/"},"modified":"2026-02-10T08:57:04","modified_gmt":"2026-02-10T07:57:04","slug":"software","status":"publish","type":"page","link":"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/software\/","title":{"rendered":"Software"},"content":{"rendered":"<p><a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/\">Lexicon<\/a> <span style=\"color: #F5B63F\">&gt; <span style=\"color: #d3cF5B63Fa9\"><b>Software<\/b><\/span><\/span><\/p>\n<p>IT Glossary<\/p>\n<p style=\"text-align: justify\">Software is a set of programs, processes and rules, and possibly documentation, related to the operation of a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/data-processing\/\" target=\"_blank\" rel=\"noopener noreferrer\">data processing<\/a> system.<\/p>\n<p style=\"text-align: justify\">It is composed of :<\/p>\n<ul>\n<li style=\"text-align: justify\">A source code;<\/li>\n<li style=\"text-align: justify\">An object code translating the source code into a machine-readable and executable language;<\/li>\n<li style=\"text-align: justify\">Functionalities allowing the user to perform a treatment.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Software is usually structured in files that can be executed by the machine concerned.<\/p>\n<p style=\"text-align: justify\">It is called upon to communicate and operate with other elements of a computer system and with users, in particular through interfaces that allow this interconnection and interaction.<\/p>\n<p style=\"text-align: justify\">The term software generally refers to any type of computer program, and therefore also to software packages that meet the general needs of several personal and SaaS that are remain in the cloud.<\/p>\n<p style=\"text-align: justify\">However, there are two main categories of software:<\/p>\n<ul>\n<li style=\"text-align: justify\">Application&#8221; software designed to assist users in performing defined tasks;<\/li>\n<li style=\"text-align: justify\">The &#8220;system&#8221; software intended to perform operations and processing related to the machine concerned.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">The operation of a software may require the implementation of <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/personal-data\/\" target=\"_blank\" rel=\"noopener noreferrer\">personal data<\/a> processing, in which case the software may be subject to the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/gdrp\/\" target=\"_blank\" rel=\"noopener noreferrer\">GDPR<\/a> and thus present appropriate technical and organizational security measures in order to guarantee the rights and freedoms of data subjects.<\/p>\n<p style=\"text-align: justify\">If the ideas and principles that underlie the logic, algorithms and programming languages of the software are not protectable by copyright law, then the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/intellectual-property\/\" target=\"_blank\" rel=\"noopener noreferrer\">intellectual property<\/a> as such, the expression of these ideas and principles can be protected by the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/copyright\/\" target=\"_blank\" rel=\"noopener noreferrer\">copyright<\/a> even though the software is utilitarian in nature.<\/p>\n<p style=\"text-align: justify\">The author of a software can thus have in particular a right of reproduction, modification and marketing of his work.<\/p>\n<p style=\"text-align: justify\">Certain aspects of the software may also potentially be protected by <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/designs-and-models\/\" target=\"_blank\" rel=\"noopener noreferrer\">design<\/a> law, provided that the form of the designs concerned is clearly distinct from their function.<\/p>\n<p style=\"text-align: justify\">In any case, the development of a software must be contractually supervised with care. The transfer of the rights to the developments must also be provided for as and when they are created.<\/p>\n<p style=\"text-align: justify\">\n<h2>Legislation focus<\/h2>\n<p style=\"text-align:
