{"id":9032,"date":"2022-02-01T18:19:46","date_gmt":"2022-02-01T17:19:46","guid":{"rendered":"https:\/\/www.cabinetbouchara.com\/udrp-uniform-domain-name-dispute-resolution-policy\/"},"modified":"2026-02-10T08:57:10","modified_gmt":"2026-02-10T07:57:10","slug":"udrp-uniform-domain-name-dispute-resolution-policy","status":"publish","type":"page","link":"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/udrp-uniform-domain-name-dispute-resolution-policy\/","title":{"rendered":"UDRP (Uniform Domain Name Dispute Resolution Policy)"},"content":{"rendered":"<p><a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/\">Lexicon<\/a> &gt; <span style=\"color: #E7B3C0\"><br \/>\n  <span style=\"color: #E7B3C0\"><br \/>\n    <b>UDRP (Uniform Domain Name Dispute Resolution Policy)<\/b><br \/>\n  <\/span><br \/>\n<\/span><\/p>\n<p>IT Glossary<\/p>\n<p style=\"text-align: justify\">The UDRP is an alternative dispute resolution process for the registration and use of top level <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/domain-name\/\" target=\"_blank\" rel=\"noopener noreferrer\">domain<\/a> names (.com, .biz, .info, .mobi, .net, .org&#8230;) as well as those corresponding to country codes that have voluntarily adopted the UDRP.<\/p>\n<p style=\"text-align: justify\">Provided that the domain <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/domain-name\/?et_fb=1&#038;PageSpeed=off\" target=\"_blank\" rel=\"noopener noreferrer\">name<\/a> extension in question allows it, any person or company may file a UDRP complaint and request the transfer or cancellation of a registered domain name.<\/p>\n<p style=\"text-align: justify\">The complaint may be filed with any approved dispute resolution institution, in particular depending on the extension of the domain name, and in particular, if necessary, before the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/wipo\/\" target=\"_blank\" rel=\"noopener noreferrer\">WIPO<\/a> (World Intellectual Property Organization), CIIDRC (Canadian International Internet Dispute Resolution Centre), ADNDRC (Asian Domain Name Dispute Resolution Centre), ACDR (Arab Center for Dispute Resolution) or the CAC (Czech Arbitration Court).<\/p>\n<p style=\"text-align: justify\">The procedure is less formal than a legal action, faster and less expensive. In any event, recourse to a UDRP procedure does not preclude either the defendant or the claimant from bringing the dispute before a competent court.<\/p>\n<p style=\"text-align: justify\">It is aimed at cases of registration and\/or abusive use of <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/domain-name\/\" target=\"_blank\" rel=\"noopener noreferrer\">domain names<\/a> infringing a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/brand\/\" target=\"_blank\" rel=\"noopener noreferrer\">trademark<\/a> right.<\/p>\n<p style=\"text-align: justify\">More specifically, the UDRP is only applicable to a dispute concerning an accusation of abusive registration of a domain name based on the following criteria:<\/p>\n<ul>\n<li style=\"text-align: justify\">The domain name is identical or confusingly similar to a trademark in which the applicant has rights;<\/li>\n<li style=\"text-align: justify\">The domain name holder has no rights or legitimate interests in the domain name;<\/li>\n<li style=\"text-align: justify\">The domain name has been registered and is being used in bad faith.<\/li>\n<\/ul>\n<h2>Legislation focus<\/h2>\n<p style=\"text-align: justify\"><span>&#8220;<\/span><i><span>You must submit to a mandatory administrative proceeding in the event that a third party (a &#8220;complainant&#8221;) asserts to the applicable provider, in accordance with the Rules of Procedure,<\/span><br \/><\/i><\/p>\n<p style=\"text-align: justify\"><i><span>(i) that your domain name is identical to, or confusingly similar to, a trademark or service mark in which the Complainant has rights; and<\/span><\/i><\/p>\n<p style=\"text-align: justify\"><i><span>(ii) you have no rights or legitimate interests in the domain name; and<\/span><\/i><\/p>\n<p style=\"text-align: justify\"><i><span>(iii) that your domain name has been registered and is being used in bad faith.<\/span><\/i><\/p>\n<p style=\"text-align: justify\"><i><span>During the administrative proceedings, the complainant must prove the truth of each of these assertions.<\/span><\/i><span>&#8221; <\/span><\/p>\n<p style=\"text-align: justify\"><span>Paragraph 4(a) of the Uniform Domain Name Dispute Resolution Policy<\/span><\/p>\n<h2 style=\"text-align: justify\">Case law focus<\/h2>\n<p style=\"text-align: justify\"><span>As an example, the World Intellectual Property Organization <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/wipo\/\" target=\"_blank\" rel=\"noopener noreferrer\">(WIPO<\/a>) was able to refuse to respond favorably to a UDRP complaint by stating that<\/span><\/p>\n<p style=\"text-align: justify\"><span> <\/span><i><span>&#8220;There are several indications that the Petitioner acted in bad faith.
