<span style=\"color: #E7B3C0\"><b>Typosquatting<\/b><\/span><\/span><\/p>\n<p>IT Glossary<\/p>\n<p style=\"text-align: justify\">Typosquatting is the registration of a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/domain-name\/\" target=\"_blank\" rel=\"noopener noreferrer\">domain name<\/a> that is similar to a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/glossary-page-3\/#M\" target=\"_blank\" rel=\"noopener noreferrer\">trademark<\/a>, a brand name, a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/family-name\/\" target=\"_blank\" rel=\"noopener noreferrer\">family name<\/a> or another domain name in order to deliberately create a risk of confusion in the mind of the Internet user and thus deceive him.<\/p>\n<p style=\"text-align: justify\">Domain name similarity is sought both visually, including the use of non-Latin alphabets (e.g. &lt;airfr\u1ea1nce.com&gt;) but also phonetically (e.g. guchi.com).<\/p>\n<p style=\"text-align: justify\">The purpose of the typosquatter can be multiple, including:<\/p>\n<ul>\n<li style=\"text-align: justify\">Resell the domain name to the owner;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Monetize the domain name with advertising revenues from the traffic it diverts by deceiving Internet users;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Redirect traffic from the domain name to a competitor&#8217;s website;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Redirect traffic from the domain name to the trademark owner itself, but through an affiliate link, which allows the typosquatter to earn commissions from the trademark owner&#8217;s affiliate program;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Stealing <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/personal-data\/\" target=\"_blank\" rel=\"noopener noreferrer\">personal data<\/a> (passwords, bank details) from Internet users by imitating the website of the copied trademark;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Installing malware or adware that generates revenue on Internet users&#8217; terminals;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Receive misdirected e-mails sent by mistake to the domain name by Internet users thinking they are addressing the owner of the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/lexique-page-3\/#M\" target=\"_blank\" rel=\"noopener noreferrer\">trademark<\/a>;<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Block malicious use of the domain name by third parties; and\/or<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify\">Expressing an opinion that differs from that of the target entity.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Typosquatting <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/domain-name\/\" target=\"_blank\" rel=\"noopener noreferrer\">domain<\/a> names do not necessarily refer to a website, and can be used only as mail servers.<\/p>\n<p style=\"text-align: justify\">It is therefore recommended that trademark owners register domain names that are similar to their trademarks, that they ensure that new domain names at risk are not registered, and that they act promptly in the event of suspected typosquatting, in particular within the framework of <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/udrp-uniform-domain-name-dispute-resolution-policy\/\" target=\"_blank\" rel=\"noopener noreferrer\">UDRP<\/a> or <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/syreli\/\" target=\"_blank\" rel=\"noopener noreferrer\">SYRELI<\/a> actions, where appropriate.<\/p>\n<p style=\"text-align: justify\">Legal action may also be taken by the victim of typosquatting, notably based on trademark infringement as well as <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/unfair-competition\/\" target=\"_blank\" rel=\"noopener noreferrer\">unfair competition<\/a> and parasitism depending on the facts of the case.<\/p>\n<h2>Update on trademark law<\/h2>\n<p style=\"text-align: justify\"><span>&#8221;
