{"id":9071,"date":"2022-02-01T14:31:56","date_gmt":"2022-02-01T13:31:56","guid":{"rendered":"https:\/\/www.cabinetbouchara.com\/mandataire\/"},"modified":"2026-02-10T08:57:32","modified_gmt":"2026-02-10T07:57:32","slug":"agent","status":"publish","type":"page","link":"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/agent\/","title":{"rendered":"Agent"},"content":{"rendered":"<p><a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/\">Lexicon<\/a> <span style=\"color: #b34322\">&gt; <span style=\"color: #b34322\"><b>Agent<\/b><\/span><\/span><\/p>\n<p>IP Lexicon<\/p>\n<p style=\"text-align: justify\">The agent in <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/intellectual-property\/\" target=\"_blank\" rel=\"noopener noreferrer\">intellectual property<\/a> is the person responsible for representing a third party, <span>(an individual or a company),<\/span> its &#8220;principal&#8221;, in particular before the Intellectual Property Offices, in order to carry out the formalities and acts necessary to acquire, maintain and defend the rights of <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/intellectual-property\/\" target=\"_blank\" rel=\"noopener noreferrer\">intellectual property<\/a>.<\/p>\n<p style=\"text-align: justify\">Thus, the person or company wishing to file a a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/brand\/\" target=\"_blank\" rel=\"noopener noreferrer\">brand<\/a>, a patent or even a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/designs-and-models\/\" target=\"_blank\" rel=\"noopener noreferrer\">design<\/a> may decide to file the application on its own or to use an agent, in compliance with the articles <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039490815\/\" target=\"_blank\" rel=\"noopener noreferrer\">R.712-2<\/a> and following, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041707813\/\" target=\"_blank\" rel=\"noopener noreferrer\">R.612-2<\/a> and following and <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000029122770\" target=\"_blank\" rel=\"noopener noreferrer\">R.512-2 and following of the Intellectual Property Code.<\/a><\/p>\n<p style=\"text-align: justify\">In some cases, however, the appointment of a proxy is mandatory, such as when:<\/p>\n<ul style=\"text-align: justify\">\n<li style=\"text-align: justify\">The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/brand\/\" target=\"_blank\" rel=\"noopener noreferrer\">trademark<\/a>, patent or <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/designs-and-models\/\" target=\"_blank\" rel=\"noopener noreferrer\">design<\/a> is registered in the name of several persons or companies: the plurality of applicants prevents the registration from being made on the head of only one of them, a common agent is required;<\/li>\n<li style=\"text-align: justify\">The applicant is neither established nor domiciled in France or in a Member State of the European Union or the European Economic Area.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">The agent, who must be specifically qualified, may include:<\/p>\n<ul style=\"text-align: justify\">\n<li>a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/intellectual-property-lawyer-and-intellectual-property-counsel\/\" target=\"_blank\" rel=\"noopener noreferrer\">lawyer<\/a>, preferably specialized in intellectual property;<\/li>\n<li>an<a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/intellectual-property-lawyer-and-intellectual-property-counsel\/\" target=\"_blank\" rel=\"noopener noreferrer\"> industrial property attorney<\/a> (CPI), a <span>profession regulated by Book IV of the Intellectual Property Code, which requires the passing of a professional qualification examination <\/span>.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Once appointed by the applicant, the agent must submit to the Intellectual Property Office, and in particular at the time of filing the application for rights, a power of attorney authorizing him to act in the name and on behalf of the applicant.<\/p>\n<p style=\"text-align: justify\">However, this does not apply to persons acting as<a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/intellectual-property-lawyer-and-intellectual-property-counsel\/\" target=\"_blank\" rel=\"noopener\">attorneys or patent attorneys<\/a>, <span>who are usually responsible for the management of their clients&#8217; trademark or design portfolio <\/span>.<\/p>\n<p style=\"text-align: justify\">Said power of attorney to be attached to the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/trademark-application\/\" target=\"_blank\" rel=\"noopener\">filing <\/a>may be in two forms:<\/p>\n<ul style=\"text-align: justify\">\n<li>It is called &#8220;special&#8221; when it authorizes the agent to act only in the specific context of a particular deposit. This power of attorney must be attached at the time of filing;<\/li>\n<li>It is said to be &#8220;permanent&#8221; when it authorizes the agent to represent the applicant in general and for all types of procedures related to his industrial property rights.
