{"id":9087,"date":"2022-02-01T11:24:01","date_gmt":"2022-02-01T10:24:01","guid":{"rendered":"https:\/\/www.cabinetbouchara.com\/droit-dopposition\/"},"modified":"2026-02-10T08:57:41","modified_gmt":"2026-02-10T07:57:41","slug":"right-to-object","status":"publish","type":"page","link":"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-to-object\/","title":{"rendered":"Right to object"},"content":{"rendered":"<p><a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/\">Lexicon<\/a> <span style=\"color: #F5B63F\">&gt; <span style=\"color: #F5B63\"><b>Right to object<\/b><\/span><\/span><\/p>\n<p>IT Glossary<\/p>\n<p style=\"text-align: justify\">The right to object to the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/data-processing\/\" target=\"_blank\" rel=\"noopener noreferrer\">processing of personal data<\/a> is one of the seven rights that data subjects have over their <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/personal-data\/\" target=\"_blank\" rel=\"noopener noreferrer\">personal data<\/a> enshrined in the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/gdrp\/\" target=\"_blank\" rel=\"noopener noreferrer\">GDPR<\/a>, namely:<\/p>\n<ul>\n<li>The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-to-information\/\">right to information<\/a>;<\/li>\n<li>The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-of-access\/\" target=\"_blank\" rel=\"noopener noreferrer\">right to access<\/a>;<\/li>\n<li>The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-to-rectification\/\" target=\"_blank\" rel=\"noopener noreferrer\">right of rectification<\/a>;<\/li>\n<li>The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-to-erasure\/\" target=\"_blank\" rel=\"noopener noreferrer\">right to erasure<\/a>;<\/li>\n<li>The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-to-limitation\/\" target=\"_blank\" rel=\"noopener noreferrer\">right to limitation of processing<\/a>;<\/li>\n<li>The <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/right-to-portability\/?et_fb=1&#038;PageSpeed=off\" target=\"_blank\" rel=\"noopener noreferrer\">right to data portability<\/a>;<\/li>\n<li>The right to object.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Under the right to object to <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/data-processing\/\" target=\"_blank\" rel=\"noopener noreferrer\">processing<\/a>, the data subject may request the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/person-in-charge-of-the-treatment\/\" target=\"_blank\" rel=\"noopener noreferrer\">controller<\/a>, at any time and for reasons relating to his or her particular situation, to stop processing personal data concerning him or her for a specific purpose.<\/p>\n<p style=\"text-align: justify\">However, this right is strictly limited to data processing with a <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/legal-basis\/\" target=\"_blank\" rel=\"noopener noreferrer\">legal basis<\/a>:<\/p>\n<ul>\n<li style=\"text-align: justify\">The performance of a mission of public interest or in the exercise of public authority vested in the controller;<\/li>\n<li style=\"text-align: justify\">Legitimate interests pursued by the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/person-in-charge-of-the-treatment\/\" target=\"_blank\" rel=\"noopener noreferrer\">data controller<\/a> or a third party.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">When data are processed for the purpose of canvassing, regardless of the <a href=\"https:\/\/www.cabinetbouchara.com\/en\/lexicon\/legal-basis\/\" target=\"_blank\" rel=\"noopener noreferrer\">legal basis for<\/a> the processing, the data subject has the right to object at any time without having to provide reasons related to his or her particular situation.<\/p>\n<p style=\"text-align: justify\">In any case, when exercising his or her right, the person concerned is not required to provide any evidence of his or her particular situation.<\/p>\n<p style=\"text-align: justify\">Indeed, the onus is on the data controller to justify that there are legitimate and compelling reasons for the processing which override the interests and rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.<\/p>\n<h2>GDPR<\/h2>\n<p style=\"text-align: justify\"><span>&#8220;<\/span><i><span>Provision should be made to facilitate the exercise by the data subject of his or her rights under this Regulation, including the means of requesting and, where appropriate, obtaining free of charge, inter alia, access to and rectification or erasure of personal data and the exercise of a right of objection. The controller should also provide the means to make requests electronically, especially when personal data are processed electronically. The controller should be obliged to respond to requests from the data subject as soon as possible and at the latest within one month and to give reasons for not responding to such requests.<\/span><\/i><span>&#8221; <\/span><\/p>\n<p style=\"text-align: justify\"><span>Recital 59 of the GDPR<\/span><\/p>\n<h2 style=\"text-align: justify\">Point of jurisprudence<\/h2>\n<p style=\"text-align: justify\"><span>The Belgian supervisory authority considers that &#8220;<\/span><i><span>The deletion of personal data also constitutes processing within the meaning of the GDPR.
