What should you do in the event of a personal data breach?
The company must react quickly to identify the source of the incident, the data concerned and the risks to individuals. If the breach is likely to affect their rights and freedoms, notification to the CNIL may be required within 72 hours of becoming aware of it. In the most sensitive situations, the individuals concerned must also be informed. In every case, the analysis carried out and the decisions taken must be documented.
When is appointing a DPO mandatory?
Appointing a data protection officer is mandatory in particular where the core activity involves regular and systematic monitoring of individuals on a large scale, or large-scale processing of sensitive data. Outside those cases, it may still be worthwhile in order to structure data governance and provide a clearly identified point of contact.
